Terms of Service
1. Acceptance of terms
These Terms of Service ("Terms") govern your use of the KlevaDesk service operated by KlevaCore LLC ("KlevaDesk," "we," "us," "our"). By creating an account, signing in, or otherwise using KlevaDesk, you agree to these Terms. If you do not agree, do not use the service.
2. What KlevaDesk is
KlevaDesk is a software-as-a-service AI voice and text receptionist for service businesses. The service answers inbound voice calls and SMS, responds with information about the partner business's services, hours, pricing, and availability, and routes booking intent back to the business owner for confirmation. Voice and SMS transport is provided through Twilio. AI generation is provided through Anthropic and Google.
3. Eligibility and accounts
You must be at least 18 years old and authorised to bind the business you represent to use KlevaDesk. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
4. Permitted use
KlevaDesk is intended to operate as a conversational receptionist on behalf of legitimate service businesses. You agree that you will not use KlevaDesk to:
- Send marketing, promotional, advertising, or solicitation content via SMS or voice.
- Send cold outbound SMS, mass broadcasts, auto-dialled campaigns, or messages to recipients who have not consented to receive them.
- Send messages or place calls in violation of the Telephone Consumer Protection Act (TCPA), CAN-SPAM, applicable state consumer-protection laws, or carrier requirements (CTIA Messaging Principles, A2P 10DLC, Toll-Free Verification).
- Impersonate any person or business other than the partner business you are authorised to represent.
- Send sexually explicit, illegal, fraudulent, hateful, harassing, or otherwise prohibited content (collectively, the "SHAFT" categories — sex, hate, alcohol, firearms, tobacco — are restricted by carriers and are not permitted on KlevaDesk).
- Attempt to interfere with, reverse-engineer, or disrupt the service.
We may suspend or terminate your account immediately if we reasonably believe you have violated this section, with or without notice.
5. SMS / messaging program
All SMS messaging sent through KlevaDesk-operated numbers is governed by the SMS Program disclosure. Customers contacting a KlevaDesk-operated number agree to the terms of the SMS Program disclosure when they opt in by texting first or by giving verbal consent during a call. By using KlevaDesk, you, the partner business, acknowledge that messages sent on your behalf will comply with the SMS Program disclosure and with U.S. carrier requirements.
6. Billing and subscriptions
Subscription fees, trial periods, and add-on charges are presented in the application at signup and at the time of purchase. Fees are billed in advance on a recurring basis until you cancel. Carrier messaging fees and per-minute voice fees may be passed through at cost. You may cancel your subscription at any time from the application; cancellation takes effect at the end of the current billing period.
7. Data ownership
You retain ownership of the content you upload or configure in KlevaDesk (your business information, services, knowledge base, tone, integration credentials). You grant KlevaDesk a worldwide, non-exclusive licence to host, process, and transmit that content as necessary to operate the service on your behalf. Conversations and recordings between your business's customers and the KlevaDesk-operated number are handled in accordance with the Privacy Policy.
8. Service availability
We work to provide reliable service but do not guarantee uninterrupted availability. The service may be unavailable due to maintenance, third-party outages (including Twilio, Anthropic, Google, or Vagaro), or other circumstances beyond our reasonable control.
9. Disclaimers
KlevaDesk uses AI to generate voice and text responses. AI output may contain inaccuracies. You are responsible for reviewing booking intents handed off to you before confirming appointments or financial transactions. KlevaDesk does not provide medical, legal, financial, or other professional advice and is not a substitute for an emergency response service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KLEVACORE LLC AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS.
11. Indemnification
You agree to indemnify and hold KlevaCore LLC harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your use of the service in violation of these Terms, applicable law, or the rights of any third party — in particular, claims arising from messages sent or calls placed on your behalf in violation of the TCPA or carrier requirements.
12. Termination
You may terminate your account at any time from the application. We may suspend or terminate your account if you violate these Terms or applicable law. On termination, your access to the service ends; data deletion follows the schedule in the Privacy Policy.
13. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Disputes shall be resolved exclusively in the state or federal courts located in Bexar County, Texas, and the parties consent to personal jurisdiction there.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "last updated" date at the top of this page and, where appropriate, notify partner businesses by email. Continued use of KlevaDesk after changes take effect constitutes acceptance of the revised Terms.
